User shall not generate or facilitate the sending of unsolicited commercial email ("spam"), which restriction includes without limitation:
  1. Sending email in violation of the CAN-SPAM Act or any other applicable ant-spam law.
  2. Imitating or impersonating another person or his, her or its email address, or creating false accounts for the purpose of sending spam.
  3. Data mining any web property to find email addresses.
  4. Sending unauthorized mail via open, third-party servers.
  5. Sending emails to anyone who has requested to be removed from user's mailing list or a mailing list that user may be affiliated with.
  6. Selling, exchanging or distributing to a third party the email addresses of any person without such person's knowing and continued consent to such disclosure.
  7. Sending unsolicited emails to significant numbers of email addresses belonging to individuals and/or entries with whom user has no preexisting relationship.
  8. Intentionally distributing viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature.
  9. Transmitting content that may be harmful to minors.
  10. Impersonating another person (via the use of an email address or otherwise) or otherwise misrepresent user's identity or the source of any email.
  11. Using the user's website or any of HyperDo's facilities to violate the legal rights (such as rigts of privacy and publicity) of others.
  12. Promoting or encouraging illegal activity.

User shall not post, upload, or otherwise transmit content, including but not limited to text, photographs, video and audio materials, which in any way violate HyperDo's policies set forth at www.hyperdo.com/policies, or which may be illegal under any federal, state, or local law, or which may subject HyperDo to litigation. HyperDo shall be the sole judge of whether user's content is in violation of this provision and upon such judgment may immediately remove user's website from its hosting server and terminate. Content which shall violate this provision include but are not limited to the following:
  1. Content which may violate any federal, state, or local law.
  2. Content which may tortious, including without limitation, content which is defamatory, slanderous, libelous, or in violation of the privacy rights of third parties.
  3. Content which is pornographic.
  4. Content which may be hateful toward or which may be deemed to encourage violent against, including but not limited to persons, entities, whether public or private, groups, associations, or religious organizations.
